Our general conditions of participation (point I) set out the agreement between you and us regarding your participation in market research studies. In our data protection information (point II) we explain what data we collect, how we use and share it, and how you can object to the processing of the data by us.

With your willingness to participate in a study and the receipt of an incentive, you agree to the present conditions of participation and also confirm that you have taken note of our data protection information.

Human8 is a group of agencies for market and opinion research, which uses various survey methods to research opinions about the companies, products and services of our clients.

I. GENERAL CONDITIONS OF PARTICIPATION FOR RESEARCH PARTICIPANTS

In principle, participation in market research studies conducted or arranged by us is not possible if you do not agree to the handling of the data you voluntarily provide us with as described here. We would therefore ask you to refrain from participating if you do not agree with the points described here. If you have any questions regarding research participation and data protection, please do not hesitate to contact us by e-mail (munich@htpeople.de).

WHAT ARE THE TYPES OF MARKET RESEARCH STUDIES/PRODUCT TESTS?

Our clients commission us with market research studies on a wide variety of topics and products. Accordingly, we offer our clients projects at individual conditions and with a variety of research methods. Thus, studies can be carried out at different locations or online. For online market research studies in particular, we make use of specific technologies and applications. An Internet connection is required to participate in our online-based studies.

In particular, we distinguish:

a) On-site studies: These take place either on the premises of H/T/P in Munich or Berlin, or in other premises or partner institutes requested by our customers. You will always receive an invitation from us with directions to the venues.

b) In-Home studies: These take place at your home. For this we or our customer arrange an appointment for a visit with you.

c) Product tests: These can be “home use tests” (you test products/product samples that we send you for a certain period at home) or tastings in our studio.

d) Online studies take place at a certain time or you are asked to participate within a certain period.

Here we distinguish between

  • Online surveys:  We will send you a survey link that will lead you to an online questionnaire.
  • Online interviews: Takes place via audio-video service providers such as Skype, Zoom, Focus Vision or similar.
  • Online communities: These are moderated portals / communities.
  • Happisodes: This is a mobile application “app”, which you can download free of charge from the respective app store (Android/iOS) and which serves us as a mobile survey platform.

Participation in our non-public survey platforms (Portal/Happisodes) programmed by us is only possible on invitation with personal login to a specific project.

COMPENSATION FOR PARTICIPATION IN STUDIES

As a study participant, you will receive an appropriate allowance for active participation in the study. We will inform you of the type and scope when inviting you to the respective study. This payment should not be fort he purpose buying or recommending the products/services.

MARKET RESEARCH STUDY RECORDINGS

Market research studies are always recorded and stored for later analysis and quality assurance purposes (digital/video/audio). You will be explicitly informed about the recordings before each study. We assume that if you participate in the study, you agree to a record and use of this data.

These recordings are neither published nor used for any other purposes outside the scope of the research. If recordings are used for training courses, lectures or publications, we may ask you for permission to use the data for these purposes before you participate in the study, with regard to the exact use and the period of use of these recordings.

The images are stored for a period of 12 months. After 6 months, these recordings are blocked and are only accessible to the data protection officer for the preservation of evidence. This storage serves only the purpose of disproving any complaints on the part of our customers regarding the fulfilment of the order. The recordings are deleted immediately when they are no longer necessary.

GRANTING OF THE RIGHT TO USE RESEARCH CONTRIBUTIONS (CONTENT DATA)

By participating in a project, you grant us the right to use materials that you have contributed in the course of your study participation (e.g. your text responses to questions, uploaded images or videos). These contents may only be processed, used and quoted in excerpts within the framework of the agreed study and for internal purposes. This granting of rights takes place without further remuneration and also includes the right to editing, as far as the editing is not distorting.

Publication and use for non-research purposes is excluded.

This also includes that you as a participant in the study assures us that your have all ownership of and exploitation rights for your contributions and any media you upload yourself (picture/video/text material and other materials), that they do not violate legal provisions such as copyright law, trademark protection law and “right to your own image” and that your contributions do not contain any indecenet content.

DUTY OF CONFIDENTIALITY/SECRECY OF RESEARCH CONTENT

All information and materials you receive during your participation in a research study (e.g. regarding study/research content, client, products/product ideas, as well as about other participants) are to be treated strictly confidentially. You may not make them available to the public, discuss them with third parties or pass them on (including to family, friends and work colleagues). This also applies beyond the period of the study.

SPECIAL NOTE: PRODUCT TESTS/EXCLUSION OF LIABILITY

The purpose of this type of study is your assessment of and opinion on new products, or products already on the market, under normal conditions of use.

All products are laboratory tested and completely harmless to health.

By participating in a product test you confirm that you take part in this type of market research study at your own risk and that you do not suffer from any known food intolerances/allergies. You also declare that you will not hold Human8 (H/T/P) or its clients liable for any consequences that may result from tasting or improper use of products and that you will not hold Human8 (H/T/P) liable in the future.

In connection with a product use test, you will receive information on the product and the manufacturer with explanations and safety instructions. This information should be read carefully and adhered to.

The product may only be used by yourself and may not be passed on to anyone else.

We would like to point out that Human8 (H/T/P) is not liable for damages in connection with the test of the product, unless the damage is based on intentional or grossly negligent behaviour of Human8 (H/T/P), its legal representatives and/or vicarious agents or it is a liability according to the product liability law.

In case of participation in a product test we will ask you to explicitly confirm this point again.

TRANSMISSION OF RESEARCH DATA/FORWARDING OF RESEARCH RESULTS (POSSIBLY WITH PERSONAL REFERENCE) TO PARTNERS/CLIENTS:

We may share your personal profile data (“screening”) with authorized persons (such as clients or business partners involved in the project) if these are absolutely necessary for the organisation, execution and evaluation of the study, as well as to fulfil quality assurance measures. A further transmission to unauthorized third parties is excluded.

The transfer also includes that the client’s client or representative has the right to monitor the achievement of the research objective by following the research project (e.g. on the institute’s premises, by means of transmission via the Internet or viewing the recordings, etc.) and to satisfy himself of the quality of the data collection. It is also possible that our clients carry out the study themselves.

All persons with authorized access to personal data are obliged to observe the confidentiality of the information and to comply with the currently valid data protection laws.

The transfer of data may also include the transfer to a third country, e.g. in the case of an international research project or international clients.
You will be informed of this fact before participating and can decide whether you want to participate anyway.

CONTACT / COMMUNICATION

Communication is by e-mail and/or telephone. By providing this information, we require your consent to its use. We will only contact you in connection with your membership in the participant database or to invite you to a study. Your e-mail address and telephone number will not be passed on by us to unauthorized third parties.

SPECIAL NOTE: IN-HOME STUDIES

For this purpose, your contact data must be transmitted to the persons involved in the project (for making an appointment and visiting you at home). We point out to you already with the invitation to the transmission of your contact data.

If you decide to participate in this type of study, we assume that you agree. You may object to this at any time or cancel your participation.

VALIDITY OF THESE CONDITIONS OF PARTICIPATION

These terms and conditions apply to all market research studies in which you participate and which are/have been conducted or arranged by us. By participating in a market research study conducted or arranged by us, you accept these conditions of participation.

H/T/P reserves the right to amend or supplement these Conditions of Participation from time to time if necessary. In this case, we will again ask you to take note and give your consent.

II. Data protection information for research participants

In the following we would like to give you our general information on the processing of your personal indentifiable data connection with participation in a research study.

Who is responsible for data processing?

Which of your data will be processed by us?

And for what purposes?

The general purpose of the processing of your data is the fulfilment of a contract with one of our customers in relation to the execution of a research order / a market research study. This includes the organization and execution of research assignments, as well as the evaluation, analysis and presentation of the results.

The following applies: We only process data that you have provided to us personally and voluntarily and only insofar as it is necessary to achieve the research purpose.

In particular, we use your personal data to determine your suitability for participation (“screening”) and for the general organization and execution of the study. Your personal data will be collected, processed and used exclusively for the specific research purpose (for which you are invited). It is not used for other (non-research) purposes (e.g. advertising, direct marketing, direct sales, etc.).

What personal data do we usually process?

  • Title, first name, surname
  • e-mail address
  • Address
  • Telephone number (landline and/or mobile)
  • information necessary for participation and invitation in the study
  • Additional information about certain preferences, products, interests, etc.
  • Account data, if applicable

This data is collected,

  • to address you correctly
  • to manage and organize the database
  • to invite or mediate you to a possible study
  • for correspondence with you
  • e.g. for certain types of studies for sending test materials, conducting the study at your home, assessing at which locations you can participate in studies
  • for the payment of the expense allowance

Secondary purpose: For the duration of your participation you will be stored in our data processing system as a participant with your name and contact details. This is done to organize the study and for billing purposes. In this case, your personal data will be stored until revoked.

If you wish to become a member of our participant database, our corresponding terms of use and data protection principles apply.

What happens to other voluntary information?

If you voluntarily provide us (e.g. as part of a study) with information that is not absolutely necessary to achieve the purpose, we will process this data. In this case, we assume that the processing and use of these data is in your interest.

What is the legal basis for this?

We usually base the processing of your data on one of the following legal bases.

Our legitimate interest (Art. 6 para. 1 lit. f) GDPR)

We have a legitimate interest in fulfilling the market research study commissioned by our client.

Since your participation in a study is completely voluntary, we assume that you have no objection to the use of your data – especially in view of the fact that you yourself decide at any time whether you would like to participate in a study and which data you share with us. We remove any personal reference as early as possible.

Your express consent in certain cases (Art. 6 para. 1 lit. a) GDPR)

We always ask for your permission if it concerns information on special types of personal data (according to Art. 9 GDPR), such as information on health, sex life, political opinions, religious views etc..  You can also give us this consent by telephone, we will then ask you to confirm this again in writing when you participate in the study.

We kindly ask you to confirm that you have read this data protection information and to accept our conditions of participation. We document this confirmation so that we can prove that you have been informed about the data processing. The legal basis here is our legitimate interest in being able to prove that we have complied with our duty to provide information (Art. 6 para. 1 lit f) GDPR).

Revocation of consent

You can revoke your consent at any time for data processing processes that are only possible with your express consent. All you need to do is send an message by e-mail to munich@htpeople.de The legality of the data processing up to the revocation remains unaffected by the revocation.

Otherwise you can object to the processing of your data and, for example, demand that you will no longer be invited for studies in the future. This will be noted and stored accordingly. You can also cancel your participation at any time.

How long is the data stored?

In principle, personal data is pseudonymised and anonymised at the earliest possible time. We store personal data until the respective research assignment is completed and for a maximum of 2 years after the end of the study. We regularly check whether personal data can be deleted.

Recordings taken during the study for analysis or quality assurance purposes are stored for a period of 12 months. After 6 months, these recordings are blocked and are only accessible to the data protection officer for the preservation of
evidence. This storage serves only the purpose of disproving any complaints on the part of our customers regarding the fulfilment of the order. The recordings are deleted as soon as they are no longer necessary.

In the event that you are interested in further storage of your personal data and have agreed to this, your data will be transferred to our participant database. There they will be stored until revoked.

Otherwise, the following always applies: If personal data is no longer required or if a contrary interest prevails, we will delete the personal data concerned, provided that it is not barred by legal storage obligations. The same applies in the event that you have objected to processing.

To which recipients is the data passed on?

Transfer of data within the company

In the company, only those persons have access to personal data that are required for the proper conduct of market research studies and only insofar as this is necessary for the fulfilment of the research purpose. Your data will be processed within the company by employees involved in the project, in particular for the organisation, execution and evaluation of the respective order.

Passing on data outside the company

In some cases we need help from external service providers or work together with partners to organise, carry out or support the fulfilment of the research assignment. We select these partners very carefully. To ensure data protection, we conclude contracts and confidentiality agreements with these partners and service providers.

Clients / representatives of the client may have access to personal data if they themselves are (co-)responsible for carrying out the study or analysis, are members of the research team or if they need to review the data to be convinced of the quality of the research method and the plausibility of the results obtained. To ensure data protection, we enter into confidentiality agreements with all persons who have access to personal data. In particular, we prohibit any attempt
to de-anonymize data that has already been anonymized / pseudonymized and to use it for other business purposes, in particular for our own. This includes any non-research activities as well as commercial activities aimed at individuals, e.g. advertising, sales promotion, direct marketing, direct sales, etc.). All persons named have been notified of compliance with the relevant legal provisions.

Where is the data processed?

In principle, your data is stored and processed on our own servers in Germany. Therefore, data collection, processing and use usually take place in the territory of the Federal Republic of Germany or in a member state of the European Union and are subject to the legal data protection regulations in force there.

Depending on the research method, we need technical support or use other providers, especially in the online area (portals, online surveys, online interviews via Skype etc.).

When is processing outside the EU?

In order to fulfil the market research mandate, in exceptional cases, data is transferred to non-European countries if the project is an international research project and/or the client is based outside the EU/EEA (e.g. USA). Please note that non-EU countries do not offer the same strict legal protection for personal data as you enjoy in Germany / the EU. In such cases, courts, law enforcement and national security authorities of that other country may access it in accordance with its laws. Therefore, we cannot guarantee data protection for countries outside the EU/EEA.

However, the customer / recipient of the data undertakes to take appropriate security measures to comply with national / European data protection principles, even in the case of cross-border transfer of personal data – provided that existing laws do not contradict this.

For third-party service providers, we make sure that we only work with service providers who are aware of data protection issues and are prepared to comply with EU standards if possible (e.g. Privacy Shield certification).

We will inform you of the transfer of data to a third country before your participation in the study, so that you can decide for yourself whether you would like to participate in this study. If you participate in research projects, you agree to the possible transfer of data to third countries.

Your rights as a data subject

You have the right to information about your personal data processed by us.

In the case of a request for information that is not made in writing, we ask for your understanding that we may require proof from you to authorize the request.

You have aright to correction,deletion or restriction of the processing, unless there are legal reasons for not doing so.

Furthermore, you have a right of objection against the processing within the framework of legal requirements. The same applies to a right to data transferability.

You have the right to complain to a data protection supervisory authority about our processing of personal data.

  • EU GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on theprotection of individuals with regard to the processing of personal identfiable data, on the free movement of such data and repealing Directive 95/46/EC (basic Regulation on data protection).
  • Personal data (pursuant to Art. 4 (1) GDPR): this refers to all information relating to an identified or identifiable natural person. Identifiable is someone who can be identified directly or indirectly, in particular by assignment to an identifier such as a name, an identification number, location data for an online identifier or other special characteristics. This means all information that refers to individual persons or is suitable to establish a connection to them. (such as images, name/contact data, preferences/interests, information on: living situations, assets, household situation, other persons, family members, state of health, marital status, etc.).
  • Processing of special categories of personal data defined in accordance with Article 9 of the EU GDPR, including, but not limited to, ethnic background, political opinion, religious or philosophical beliefs or trade union membership, health data, data on sex life or sexual orientation.
  • Processing of personal identifable  data: based on the definition of Article 4 GDPR, processing includes collection, collection, organisation, arrangement, storage, adaptation or modification, reading, retrieval, use, disclosure by transmission, dissemination or any other form of provision, comparison, restriction, erasure or destruction.
  • Third parties: this means anyone authorized by us or by us to process the data (e.g. contractors). Persons who are absolutely necessary for the organisation, implementation, analysis and quality control of the project are not considered unauthorised third parties.
  • Recipients of data are all persons to whom the data is disclosed.
  • Third country: A country outside the EU
